GoMalaysians! Terms and Conditions

A. General

1. GoMalaysians! (“Contest”) is organized by GoCar Mobility Sdn. Bhd. (hereinafter referred to as the 'Organiser').
2. The Contest is subject to the terms and conditions (“T&C”) stated herein and as varied, added, modified, and/or altered (“Variations”) from time to time during the Contest Period as defined herein. The Organiser reserves the absolute right to make such Variations by posting such Variations at the GoCar Facebook & Instagram page and any Eligible Participant as defined herein in the Contest is advised to check and shall check for any update at the GoCar Facebook & Instagram page from time to time for any such Variations which shall be effective on the date of posting. 
3. By participating in this Contest, the Eligible Participant is deemed to have read and understood and further deemed to agree and declare that he and/or she has read and understood the T&C herein and agree(s) to be bound by the same. 

B. Contest Period

1. This Contest will commence on 1st August 2023 at 11:59 pm until 30th September 2023 at 11:59 pm (Malaysian time)  (“Contest Period”). Any entries received after the respective Contest Period will be automatically disqualified. 
2. The Organiser however reserves the right to extend or shorten the Contest Period by way of online Variations as provided under clause 2 of section A. 

C. Eligibility

1. The Contest is open to 

(i) Malaysian citizens and permanent residents ( PR ) in Malaysia

(ii) Open to 18 years and above with a valid Malaysian Driver’s License or International Driver’s Permit, and

(hereinafter referred to as the “Eligible Participant”)

2. The Contest is not open to: 

1. Any employees, agents, or representative of the Organiser (including the holding company or subsidiaries and related companies) and/or their immediate family members (spouse, children, parents, brothers, and sisters); or

(ii) The Organiser’s authorized dealers, sales promotion agencies and advertising agencies, including their immediate family members and/or Affiliates of the Organizer or anyone else connected to the administration and execution of the Contest.

D. Contest Mechanism

1. To participate GoMalaysians! Contest, the participant is required to:
   • Make one or more bookings for GoCar Sharing (Round Trip). Only bookings that are paid in full will be eligible to be included in the Contest
   • Bookings must utilize campaign promo code KITAMERDEKA and/or GOSARONG 
   • Bookings and travel dates must be within the campaign period of 1st August 2023 to 30th September 2023.
2. For Bi-Weekly winners, a winner will be selected at random, open to all participants that meet the criteria listed in point D.1.
3. For the Grand Prize, the customer with the highest amount spent in Ringgit Malaysia on bookings for GoCar Sharing (Round Trip) using the campaign promo codes shall be the winner of the Contest that meets the criteria listed in point D.1.
4. The booking period for the Contest winners is as follows:

5. In the event of a tie, the participant with the highest booking count and/or Ringgit spent will be the selected winner.
6. Participants who are under ‘Blocked’ status will not be eligible to participate in the Contest.
7. The winner(s) will be contacted and notified via GoCar Facebook (https://www.facebook.com/gocarmalaysia/) & Instagram (https://www.instagram.com/gocarmy/) page. 
8. It is the Eligible Participant’s responsibility to check GoCar's Facebook & Instagram page for the winner's announcement and respond to GoCar within fourteen (14) days from the date of notification or posting or contact by GoCar, failing which, the Organiser reserves the absolute right to select another winner(s) in replacement and any such selection shall be final and conclusive.

E. Prizes

1. The prize(s) (“Prize(s)”) for the Contest is as follows:

2.   All prizes will be couriered to the mailing address provided by the winners within 60 days from the end of the campaign date.

3.  All winners are only able to win one (1) prize.

4. The prize(s) is not transferable, exchangeable, or redeemable for cash or any other form. Notwithstanding the above, the Organiser reserves the right to replace the prize with other prizes of equal value, without assigning any reason whatsoever or prior notification.

F. General Terms & Conditions

1. The decision of judges in determining the winner(s) is final, conclusive, and binding and no appeal will be allowed and entertained.
2. The Organiser (including its respective employees, staff, and agents) shall not be liable for any loss (including loss of opportunity and consequential loss arising therewith) and/or any damage suffered by any Eligible Participant or eventual winner(s).
3. The Organiser shall not be responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of our website or network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet.
4. The Organiser shall reserve its rights to publish or display materials or information, including but not limited to the names of Eligible Participant for marketing, advertising, and publicity purposes in any manner it deems appropriate. The Organiser further reserves its right to use any personal data of Eligible Participant in any manner and/or for any purpose it deems fit and the Eligible Participant is deemed to consent and hereby agrees and consents to such use with no monetary payment. 5. The Organiser reserves its right to cancel, terminate or suspend the Contest with or without any cause and/or any prior notice. For the avoidance of doubt, any cancellation, termination, or suspension by the Organiser shall not entitle the Eligible Participant to any claim and/or compensation against the Organiser for any and all losses or damages suffered or incurred whether direct or indirect result of the act of cancellation, termination or suspension.
6. The Organiser reserves the right to verify any or all information supplied by any applicant and/or Eligible Participant(s) and each applicant and/or Eligible Participant agrees to assist the Organiser.
7. The Organiser reserves the absolute right to disqualify any Eligible Participant subsequent to the successful application (“Disqualified Participants”) in the event that the Organiser is of the opinion that the Eligible Participant has been found to have tampered or suspected of tampering with the Contest submission process and/or the operation of the Contest and/or in violation of the conditions of access of the website or usage policy of the website. The Organiser reserves the right to forfeit any Prize and/or reward if the Organizer is of the opinion that the Eligible Participant has undertaken fraudulent practice and/or activities or other activities harmful to the Contest or the Contest submission process.
8. The T&C herein shall prevail over any inconsistent terms, conditions, provisions, or representations contained in any other promotional or advertising materials for the Contest. In the event of any inconsistency, conflict, ambiguity, or discrepancy between the English version and any other version in other languages of these T&Cs, the English version shall prevail at all times.

G. Indemnity 

The Eligible Participant and/or subsequent Disqualified Participant shall indemnify and hold the Organizer including its directors, employees, affiliates, service providers, and relevant business partners, harmless from and against all claims, liabilities, damages, fines, losses, and/or expenses however arising incurred or sustained by the Organizer as follows: 

• In respect of any alleged or actual infringement of any intellectual property rights, copyright, trace and/or service mark, design rights of any third party by the Eligible Participant and/or Disqualified Participant made in connection or arising out of this Contest; 

• Any loss and/or damage sustained by the Organizer as a result of the Eligible Participant’s and/or subsequent Disqualified Participant’s breach of the T&C herein; 

• In respect of any result of any breach caused by the Eligible Participant(s) and/or subsequent Disqualified Participant of the provisions of the Personal Data Protection Act 2010. 

H. Anti-Bribery & Anti-Corruption Policy (ABAC)

1. The Organiser takes a zero-tolerance approach to violation of any applicable anti-corruption and anti-bribery laws and regulations by you, your employees, officers, directors, sub-contractors, and/or Affiliates. 
2. Any violation thereof constitutes a material breach of the terms herein which entitles the Organiser to forthwith terminate the Services herein and the agreement between the parties (where applicable) and/or enforce its right and seek remedies available to it at law or in equity as a result of such breach. 
3. For the purpose herein, "Affiliates" shall mean that with respect to an entity, any entity that: 

(i) is controlled directly or indirectly by; 

(ii) controls directly or indirectly, or 

(iii) is under common control with such entity; and "control" for the purpose of this definition shall mean having a fifty percent (50%) or greater interest in the issued share capital of the other entity.
